These Terms of Service (“Terms”) govern your access to and use of BinnacleCrew (the “Service”), operated by Binnacle AI (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What BinnacleCrew is
BinnacleCrew is a study and credential-management tool for individual mariners credentialed (or seeking credentials) by the United States Coast Guard. It provides practice questions, study guides, mock exams, credential expiration tracking, a sea-service log, and document-generation aids.
BinnacleCrew is not affiliated with, endorsed by, or sponsored by the United States Coast Guard, the National Maritime Center (NMC), or any government agency. The Service does not provide legal advice and is not a substitute for the official USCG examination, application, or approval process. You are solely responsible for verifying all information before submitting anything to the NMC.
2. Accounts
You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Provide accurate information and keep it current. Notify us promptly of any unauthorized use.
3. Free and paid tiers
The Service offers a free tier and a paid “Exam-Prep” (Pro) tier. Pro is available as a recurring monthly subscription or a one-time study pass that grants Pro access for a fixed term (approximately six months / 183 days from purchase). Prices are shown at checkout. We may change pricing prospectively; changes do not affect a study pass already purchased or the current paid period of an active subscription.
4. Billing and cancellation
Payments are processed by Stripe. Monthly subscriptions renew automatically until cancelled. You may cancel at any time from your account settings; cancellation stops future renewals and your Pro access continues until the end of the current paid period. Refunds are governed by our Refund Policy.
5. Acceptable use
You agree not to:
- copy, scrape, resell, or redistribute the question bank, study content, or other materials;
- share your account or use it on behalf of multiple people;
- attempt to bypass tier gating, security controls, or rate limits;
- upload unlawful content or another person’s documents without authorization;
- use the Service to violate any law or the rights of others.
6. Your content
You retain ownership of the documents and data you upload (such as credential images and sea-service letters). You grant us a limited license to process that content solely to provide the Service — including sending it to our document-processing providers to extract fields you have asked us to read. We do not sell your content. See our Privacy Policy.
7. Intellectual property
The Service, including the question bank, study guides, software, and branding, is owned by us and protected by intellectual-property laws. We grant you a personal, non-transferable, revocable license to use the Service for your own credential preparation. No other rights are granted.
8. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind. We do not guarantee that study content, eligibility calculations, processing-time estimates, or AI-extracted fields are accurate, complete, or current, or that using the Service will result in passing any exam or obtaining any credential. Regulatory requirements change; always confirm against the current 46 CFR, NVICs, and NMC guidance.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, consequential, or punitive damages, or for lost credentials, lost income, or missed deadlines arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access for violation of these Terms. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability) will survive.
11. Governing law
These Terms are governed by the laws of the State of Hawaii, USA, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Honolulu, Hawaii.
12. Changes
We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above. Continued use after changes take effect constitutes acceptance.
